1. Who we are

Nyxiss is a personal AI companion service operated by Karel (the "Operator"). By creating an account or using the service, you agree to these terms.

2. Eligibility

You must be at least 16 years old to use Nyxiss. The service is not designed for users under that age.

3. Account & Security

  • You are responsible for keeping your password confidential.
  • One account per person. Sharing accounts is not permitted.
  • We may suspend accounts that violate these terms or applicable law.

4. What Nyxiss is — and is not

Nyxiss is a companion AI for conversation, productivity, and creative tasks. She is not a substitute for:

  • Medical, legal, or financial professional advice
  • Mental health treatment or crisis intervention
  • Emergency services (call 112 or your local emergency line)

Nyxiss can make mistakes. Verify important information independently.

5. Acceptable Use

You agree not to use Nyxiss to:

  • Generate illegal content (CSAM, harassment, threats, fraud)
  • Attempt to extract, copy, or reverse-engineer the service
  • Resell access or use bots/scripts to scrape
  • Impersonate another person or claim false identity

6. Subscriptions & Billing

  • Free tier: 10 messages per day on GPT-5, no persistent memory.
  • Paid plans (Plus, Pro, Max) are billed via Stripe in advance.
  • Cancel anytime — access continues until end of paid period.
  • We do not refund partial periods unless required by law.

7. Content & IP

  • Your conversations and uploaded content belong to you.
  • Nyxiss's persona, code, and brand are owned by the Operator.
  • We don't train models on your private conversations.

8. Service Changes

We may update features, pricing, or terms with reasonable notice (typically email or in-app banner). Continued use after changes means acceptance.

9. Disclaimers

Service is provided "as is". To the maximum extent permitted by law, we make no warranties about uptime, accuracy, or fitness for a particular purpose.

10. Termination

You can delete your account anytime from the Memory dashboard. We may terminate accounts that violate these terms.

11. Governing Law

These terms are governed by the laws of the Czech Republic. Disputes shall be resolved in Czech courts with proper jurisdiction.
